Habitability of Rental Properties

Habitability is defined in California by Civil Code 1941.1. It generally refers to the condition of being suitable or fit to live in and provides the minimum standards a landlord must provide to ensure that a rental property is both safe and livable for human occupancy. These standards include the following: (1) Access to both hot and cold running water in the kitchen and bathrooms; (2) Sewage disposal; (3) Heating at all times of the year; (3) Safe and functional electric wiring, outlets, and lighting; (4) Structural soundness;, (5) Doors,and windows with weather stripping that functions properly; (6) No pests including insects and rodents; 7) A roof, windows, and walls that do not allow water intrusion; (8) Functional plumbing, including fixtures that do not leak; (9) A toxic mold free environment; and (10) Smoke and carbon monoxide detectors.
